Extension of the ERTE until 28 February 2022
prorrogan The ERTE until 28 February 2022 with some changes with regard to the anterior extensions and that affect to the companies:
1/ The ERTEs current will be valid during October of 2021 so that so many companies like workers have the sufficient time to receive to what arouses the new norm that prorroga the ERTE.
The application of the extension of a new ERTE from 31 October 2021 can present during the month of October following the ordinary procedure. In case of absence of resolution expresses will understand estimated by silence.
2/ New ERTEs from 1 November 2021 that it will be when they will go in in force the new helps, as well as the new modalities of ERTE that brings us the new extension: ERTE by impediment and traffic to a file by limitations to the activity normalised or vice versa.
3/ Actions of formation in ERTE from November
From 1 November, they will be valid the new modalities, with main exemptions in the cotización to the Social Security for the companies that make formative actions. These formative actions have to carry before 30 June 2022.
4/ The exoneración of quotas will depend the formation
- For companies of more than 10 workers with files of limitation, the exoneraciones will be of 40% in the case that it do not impart formation and of 80% in the case that yes it carry
- For companies of until 10 employees the exoneraciones of quotas to the Social Security will be of 50% if the company denies to form to his workers and of 80% in the case that if they carry formative actions. REGARDING the ERTE of impediment (when the ejercimiento of the professional activity is forbidden by sanitary reasons),the exoneraciones for all the companies will be of 100%.
Which length has to have the formation?
-Companies from among 10 and 49 empelados: the formative actions will have to be of 30 hours of length
-Companies of more than 50 employees: the formative actions will have to be of 40 hours of length
The aim of this measure is that the workers take advantage of his stay in the ERTE to form . These activities of formation will fund with an increase of credit for the financing in the field of the formation programmed.
5/ Enlargement of the clause of the maintenance of the use in the ERTE that applies according to the had in the article 5 of the Royal decree-law 30/2020, in relation with the anterior periods and with which derives of the profits collected in the new extension.
Which limitations maintain ?
- The limitations to the outsourcing.
- The limitations to the realisation of extraordinary hours.
- The limits on distribution of dividends and the access to these helps by companies domiciliadas in tax havens.
