1. New cotización so much for companies as for his workers: Mechanism of Equity Intergeneracional
 
From the past 1 January has set the MEI. It treats of a mechanism that fixes an increase of cotización of 0,6 points porcentuales applied on the base of common contingencies in all the situations of tall or assimilated to the one of tall in the system of the Social Security in which it exist the obligation to quote for the coverage of the pension of retirement: the companies assume 0,5% and the employees pay 0,1% remaining.

2. Rise of the maximum bases of cotización

The tope maximum of the base of cotización in each one of the regimes of the Social Security that have it established remains fixed in the quantity of €4.495,50 monthly euros.
REGARDING the minimum bases of cotización, will augment in function of the increase of the Minimum Salary Interprofesional.
The types of cotización do not vary with regard to 2022:
- For the common contingencies maintains the 28,30 %: 23,60 % to charge of the company and the 4,70 % to charge of the employee.
- For the contingencies of accidents of work and professional illnesses will apply the percentages of the price of included premiums in the additional disposal 4ª of the LPGE for 2007, being the resultant premiums to exclusive charge of the company.

3. It augments the quantity of the provision by unemployment

Another of the labour novelties to stand out for 2023 is the increase of the contributory provision by unemployment that spends of 50% to 60% of the regulatory base from the day 181 (this is, the seventh month) of the perceive of the provision.
- Six first months: 70%
- Rest of the time: 60%
According to the Government, this measure will benefit to some 300.000 people and will suppose an improvement of 100 euros of average.

4. Novelty regarding the plans of equality

As fourth labour novelty stand out one of which enters the LPGE and that has gone in in force  the day 1 January 2023: it has modified the Law 9/2017 of agreements of the public sector and raisin to have that the companies obliged to have plan of equality (from 50 workers) can not hire with the Administration and other entities of the public sector if they do not have of a plan of equality according to the indicated in the article 45 of the Organic Law 3/2007, of 22 March, for the equality of women and men.

5. Bases of cotización in the RETA

The PGE 2023 reflect the new bases of cotización of the Special Regime of Autonomous Workers. The most remarkable modifications are:
- Maximum base of cotización: 4.495,50 monthly euros.
- REGARDING the cotizaciones common, the type of cotización becomes of 28,30% and for the professional contingencies of 1,30% (0,66% contingency of temporary inability and 0,64% the ones of permanent inability and death and survival).
It is necessary to stand out the update that has produced in the maximum bases of cotización of the tracts 11 and 12 of the RETA: they elevate of the 4.139,40 €/month until the 4.495,50 €/month, what means that in these tracts, the maximum quota pass of 1.266,66 euros/month to 1.375,62 euros/month
WITH REGARD TO the calculation of the base of cotización by real income, signal that it adjusts the quota to the net performances of the autonomous worker.

6. Revaluation of the pensions

REGARDING the pensions, it is necessary to stand out that the amount to perceive by public pensions will not be able to surpass, during the year 2023, the monthly whole quantity resultant to apply to the whole quantity of 2.819,18 euros the increase porcentual equal to the half value of the taxes of variation interanual expressed in so much percent of the IPC of the 12 previous months to December of 2022, without prejudice to the bonuses that could correspond to his headline, whose quantity also will be affected by the mentioned limit.

7. The worker no longer will have to hand to the company his medical drop

With effects from the day 1 April 2023, modifies the RD 625/2014, of 18 July, by which fix determinate appearances of the management and of the control of the processes by temporary inability in the first 365 days of his length.
The new Royal decree enters these novelties:
- In relation with the medical parts of drops and tall only will hand  a copy to the worker/to.
- It deletes the second copy.
- The hard-working person no longer will have to hand the copy of the part of drop to his company.
- The communication among entities emisoras and the National Institute of Social Security will be telematic.

8. New planned permissions in the Preliminary draft of the Law of Families

The predictable future Law of Families would include three new destined permissions to conciliate the personal and labour life:
- Permission rewarded of five days to the year for the care of familiar in case of hospitalisation, accident or grave illness, or surgical intervention (until 2º degree or conviviente)
- Permission no rewarded of six weeks until the minor of age fulfil eight years (will be able to enjoy of continuous or discontinuous form). In 2024 this permission will become of eight weeks.
- Permission rewarded of four days to the year to attend to familiar that require attention.

9. Possible rise of the SMI

Recently, the Government has announced that the SMI could go up in the weeks to come of 2023 until the 1.080 €, situating in 60% of the half salary in Spain. Of this way, the SMI for 2023 goes to go up in 8%, what will ensure the 1.080 monthly euros in 14 pays.

10. Permission preparto and drop rewarded by painful menstruations

The Project of Law by which modifies the Law of sexual and reproductive health and of the voluntary interruption of the pregnancy includes a “labour permission preparto” from the week 39 of gestation, that would be an automatic drop and would not consume any day of the permission of motherhood.
Another of the novelties that enters this Law is the possibility to receive to a drop rewarded by menstruations especially painful (which, until it approve and publish the Law, require of medical certificate).
